Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you ("you" or the "Customer") and ECU Recovery ("ECU Recovery," "we," "us," or "our") governing your access to and use of the website located at ecurecovery.com and the services offered through it (together, the "Service"). Please read these Terms carefully. By accessing the website, submitting a file, or completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

  • ECU — the electronic control unit that manages a vehicle's engine or related systems.
  • Map File — an ECU configuration or tuning file that you upload to the Service.
  • Recovery — the process by which we help the rightful owner regain access to a Map File they are authorized to access, by recovering a forgotten password or otherwise restoring the authorized owner's access so the file can be opened in the owner's tuning software.
  • Result — the processed file and/or recovered credentials we deliver to you following a successful Recovery.

2. Service Description

ECU Recovery provides a professional password recovery and access-restoration service for ECU Map Files. Our Service assists rightful owners and their authorized representatives in regaining access to configuration files they own or are otherwise lawfully entitled to access — for example, where a password has been forgotten, or where the owner is otherwise unable to open or edit their own file. The Service is limited to restoring access for the authorized owner; it does not modify the calibration contained in your file, and it may not be used to access any file that you do not own or are not authorized to access.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) and able to form a legally binding contract to use the Service. By using the Service, you represent that you meet these requirements and that your use of the Service complies with all laws and regulations applicable to you.

4. Authorization and Lawful Use

The Service is intended solely for the rightful owner of a Map File, or a professional acting on that owner's explicit authorization. By submitting a file, you represent and warrant that:

  • You own the Map File, or you have the express, verifiable authorization of the owner to request its Recovery;
  • You have the lawful right to access the data contained in the file and to request recovery of your own access to it;
  • You are not using the Service to gain unauthorized access to any file, software, intellectual property, or system belonging to a third party; and
  • Your use of the Service and of any Result complies with all applicable laws, regulations, and any contract you have with a third party.

You are solely responsible for ensuring that you hold the necessary rights before submitting a file. We may, at our discretion, decline or cancel any order and refuse service to anyone where we reasonably believe these requirements are not met.

5. Prohibited Uses

You agree that you will not, and will not attempt to, use the Service to:

  • Access, copy, or alter any file, data, or intellectual property that you do not own or are not authorized to access;
  • Infringe the intellectual property, contractual, or privacy rights of any third party;
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation, including export controls and sanctions programs; or
  • Interfere with, disrupt, or compromise the integrity or security of the Service.

You are responsible for how any Result is used once it has been delivered to you.

6. Fees, Payment, and Verify-First Model

We operate on a verify-first basis: we confirm that we are able to produce a working Result for your file before any payment is requested. You will only be charged once we have verified that Recovery is possible for your file.

  • Price: USD $160 per file, for all supported ECU types, unless a different price or promotion is expressly stated at checkout;
  • Accepted payment methods: PayPal and cryptocurrency (processed by our third-party payment providers);
  • All prices are stated in U.S. dollars and, unless otherwise indicated, are exclusive of any taxes that may apply in your jurisdiction.

7. Refunds, Digital Delivery, and Payment Disputes

Verify-first refunds. Because we confirm that a working Result can be produced before charging, you receive a functional Result in the ordinary course. If a delivered Result is corrupted, does not open correctly in the corresponding ECU management software, or the recovered password is incorrect, you are entitled to a full refund. To request one, contact us at support@ecurecovery.com within 14 days of delivery with a description of the issue. When you request a refund, we re-examine the file associated with your order to confirm whether the recovery was in fact successful; if our review confirms the Result did not work as described, we issue a full refund, and where appropriate we may instead re-process the file. Nature and delivery of the goods. The Service delivers custom digital goods — a recovered or re-processed ECU file and/or the associated credentials — prepared specifically for the file you submit and delivered electronically. Delivery is complete when the Result is made available to you for download. You acknowledge that, once you have downloaded and received the Result, the digital goods have been delivered, received, and accepted as described.

Resolving concerns directly. If you are unsatisfied or believe a charge is incorrect, you agree to contact us first and use the refund process described in this Section so that we can resolve the matter directly and promptly. For any order that has been delivered and accepted, you agree not to initiate a chargeback or payment dispute, except where required by applicable law or where we have not provided a remedy you are entitled to under this Section. This commitment does not limit any rights you cannot waive under applicable law or under the terms of your payment provider.

Records of delivery. We maintain complete, time-stamped records for every order, which may include order and verification logs, download access logs, IP addresses, email correspondence, and delivery confirmations. Where a payment dispute is raised, we will provide these records to the relevant payment provider to demonstrate that the goods were verified, delivered, and received as described. We keep these records solely to substantiate our performance and to help resolve any dispute fairly and transparently.

8. File Handling and Data Security

Files you submit are transmitted over encrypted connections and encrypted at rest using AES-256. Results are made available through time-limited download links. We retain submitted files and Results only for the limited period described in our Privacy Policy, after which they are permanently deleted. Please review our Privacy Policy for details on how we collect, use, and retain data.

9. Service Availability and Supported Files

We do not guarantee that every file can be processed. Support depends on the ECU brand, software, and firmware version, and may change over time. Where we determine that a file cannot be processed, you will not be charged for it. The Service is provided on an "as available" basis, and we may modify, suspend, or discontinue any part of it at any time.

10. Intellectual Property and Customer Ownership of Files

The website, its content, branding, and software are owned by ECU Recovery or its licensors and are protected by applicable intellectual property laws. These Terms do not transfer any ownership in our intellectual property to you.

Customer ownership of files. You retain full ownership of every file you upload. ECU Recovery does not claim any ownership of your files or the data they contain. You grant us only a limited, non-exclusive license to analyze, process, and return the requested Recovery, solely for the purpose of providing the Service to you. No ownership rights in your files are transferred to ECU Recovery, and we do not use your files for any purpose other than delivering the Service and, where applicable, resolving a payment dispute or complying with law.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that any particular file can be processed.

12. Limitation of Liability

To the fullest extent permitted by law, ECU Recovery and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service or any Result. Modifying, tuning, or operating an ECU or vehicle is undertaken at your own risk, and we are not responsible for any damage to your ECU, vehicle, or engine resulting from the use of any Result. Our total aggregate liability arising out of or relating to the Service will not exceed the amount you paid to us for the order giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless ECU Recovery and its owners, employees, and contractors from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Service, or your violation of any law or of the rights of any third party, including any claim that you were not authorized to submit a file for Recovery.

14. Third-Party Services

We rely on third-party providers for payment processing and email delivery, including PayPal, NOWPayments, and Resend. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.

15. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or if we reasonably believe your use is unlawful or unauthorized. Provisions that by their nature should survive termination — including authorization representations, disclaimers, limitations of liability, indemnification, and governing law — will survive.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws applicable at the place where ECU Recovery operates, without regard to conflict-of-laws principles, and subject to any mandatory consumer-protection laws of your country of residence that cannot be excluded by agreement. Before commencing any formal proceeding, you agree to contact us so that we may attempt to resolve the matter informally and in good faith. Any dispute that cannot be resolved informally will be submitted to the courts or dispute-resolution forum having proper jurisdiction, or, where both parties agree in writing, to binding arbitration.

18. General

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ECU Recovery regarding the Service. We are not liable for any failure or delay in performance caused by events beyond our reasonable control.
